« By Terry » is a SAS with a capital of 1 746 000€ registered at 37-39 rue de surene - 75008 PARIS under the RCS 410318968.The website of the company By Terry is a website for online sales via the Internet using the address www.byterry.fr. It is accessible to all users of this network. It is edited by Byterry and commissioned by Onibi SAS with a capital of 100 000 euros, registered in Paris under the RCS 509 553 285, whose headquarters is located 3 Rue Miton 75009 Paris, which creates and operates By Terry's e-commerce activities. The entire contents of the website are hosted by NBS SARL with a capital of 203 905 euros, registered under the RCS 423 410 901, whose headquarters is located 2 rue Jean Rostand 91400 Orsay.
This website allows the company By Terry to offer to the all internet users the possibility to buy all By Terry branded products. To simplify the application of these conditions, it is agreed that the User having validated an order will be referred to as "Buyer". The rights and obligations of the User apply to the Buyer.
Moreover, the user can save and print By Terry's « Terms and conditions » but he is not allowed to modify them.
The order doon by the User will be deemed as valid only after he has consulted and accepted these Terms and Conditions of sale without reserve, that acceptance is conditioned by a handwritten signature from the user. These conditions apply to the exclusion of any other document.
The company By Terry SAS reserves the right to change the content without any notice. These changes will apply only to users who have previously consulted and agreed with the content when ordering.
2. Criteria for the validation of your order
If one or more products become unavailable after you submit an order, you will be notified by mail within 48 hours. The amount of your order will be recalculated and you will be debited for the amount of goods shipped. If your order is completely unavailable, you will be notified by mail and you will not be charged.
The photographs, graphics and descriptions of products offered for sale are indicative only and do not bind the seller.
3. Prices of products on the website
Prices listed on this website are only in Euros, all taxes included - at the rate of VAT applicable on the date of the order - and are likely to change during the year. Prices charged are those listed on the date of registration of the order. In case of change of VAT rate, By Terry Sarl will automatically apply the new rate to the order.
Product prices do not include delivering costs, but they will be displayed in the shopping bag at the time of final confirmation of the order.
The selling prices of products may be modified by « By Terry » SAS anytime. This change will be reported to the Buyer before ordering.
4. Orders
When the order is confirmed by clicking the "Continue" button, the Buyer hereby accepts it and these Terms and Conditions. Upon registration of the order, a detailed receipt containing all the selected items will be sent to the Buyer at the email address he/she has given. The acknowledgment will indicate the exact amount charged and the way of delivery.
This email acknowledgment constitutes acceptance of the order and confirms the transaction. The Buyer agrees that the order registration systems of By Terry SAS are a valid evidence of the nature of the agreement and its date.
However, if there is a dispute with the Buyer, By Terry SAS reserves the right to cancel the order and the regulation of the Buyer/along with the settlement of the Buyer.
By Terry reserves the right to cancel any orders that might have seemed unusual - a large number of the same reference ordered, value of orders abnormally high, request for shipping in a country not listed in Article 3 of the present Terms and Conditions, orders denominated in a currency other than EURO -.
5. Payments
The transaction is operated by the secured payment solution Elys Net HSBC. All orders are payable in euros and by credit card only. Cards accepted on the website are: Visa, Mastercard and Cart Bleu. CyberMUT.
At the end of your order, you will be redirected to the secure payment solution Elys Net HSBC to make payment. All your financial information are never communicated to www.byterry.com website.
Payment is made in a secure area where the URL begins with https: / / (where "s" means secure), where information is encrypted and therefore protected before being transferred via the Internet.
6. Order delivery
The products are sold only to customers whose shipping address is located in France or the UE countries:
-Latvia, Austria, Lithuania, Luxembourg, Bulgaria, Malta, Cyprus, Denmark, Poland, Portugal, Estonia, Czech Republic, Finland, Romania, United Kingdom, Greece, Slovakia, Hungary, Slovenia , Ireland, Sweden, Belgium, The Netherlands, Switzerland, Italy, Spain and Germany.
The products are delivered to the shipping address you have provided during the ordering process. In case of delayed shipment, an e-mail will be sent to inform you of a possible effect on the date of delivery that was appropriate.
6-1 Standard Delivery
The package is placed in the mailbox addressed to the Purchaser or the receiver of the goods ordered. In the case, the mailbox's size is insufficient, the package is delivered to your home (Buyer or the consignee of the goods ordered).
When the package hasn't been delivered for the reasons mentioned above, the buyer or recipient of the order receives a calling card, allowing him to withdraw the products at the carrier office specified in the notice of passage for a period of fifteen days.
After this period, the parcel is returned to the sender. No dispute on the delivery itself is possible if the package appears to have been delivered (proof of the delivery service).
If there is an anomaly on the package (including damaged parcel, package opened, liquid mark, etc. ...), the buyer or consignee of the goods ordered must not open the package but he is asked to bring unopened within five working days in a carrier office and asked to do a « domage report ». The opening of the parcel has no recourse to the carrier. It is also requested to report the problem to BY TERRY by calling customer service at customerservice.eu@byterry.com .
If there is an anomaly with the contents of the package (missing product, damaged product, ...), the buyer or consignee of the goods ordered are requested to report the problem to BY TERRY by contacting customer service at: customerservice.eu@byterry.com
6-2 Delivery times
For all orders confirmed Monday to Friday (excluding holidays) before 13h on the website BY TERRY, preparation of the order will place the same day, within the limits of available stocks. The delivery times, following the order conditions:
- Colissimo 48H : under 48 heures
- Livraison 24H Express : under 24 heure
The buyer may exerce this right to cancel his order for a delivery failure the contractual period, within a maximum of sixty days (« ouvrés courant ») from the maximum specified delivery times products.
7. Return and refund of products
Products can be returned by the Buyer in the following conditions:
The products must be returned to By Terry in perfect condition for resale in their original condition - unopened package -. Returning fees are charged to the customer. It will not accept any packages or insufficient prepaid postage.
In case of shipping error of products by « By Terry », the return postage will be refunded to Buyer.
By Terry accepts the return of any item purchased on the website if it is returned within 7 calendar days from the date of receipt of the order by the Purchaser pursuant to Article L. 121-20 of the Consumer Code.
To return an item, the Purchaser must follow these instructions:

Any risk linked to the return of the product is borne by the Buyer.

By Terry will send within 15 days of receipt of the returned order a check as reimbursement for the canceled order.
8. Reserve Property
« By Terry » SAS retains full ownership of the goods sold until full payment is received, in principal, fees and taxes.

By Terry can not be held liable for breach of contract in case of stock shortage or unavailability of product due to a major force, disruption or total or partial strike of postal services and transport and or communications.
By Terry can not be held liable for any damages that may arise from the purchase of products.
By Terry can not be responsible for any loss of data files. The responsibility belongs to the Buyer to conduct all the necessary safeguards.

- For any occurrence of bugs;
- For any inaccuracies or omissions relating to information available on this website;
- For any damage resulting from fraudulent intrusion by a third party leading to changes in information made available on the website;
- And more generally for any direct or indirect, whatever the causes, origins, natures or consequences, including such costs may arise from the acquisition of goods on the website, loss of profits, goodwill , data or other intangible losses that may result from anyone accessing the website or inability to access or reliance upon any information obtained directly or indirectly from it.
